In today’s volatile real estate market, it is critically important to assure clear title when purchasing or even conveying real property. A “clouded” title or lack of title insurance may expose your real estate to liens, judgments or other adverse matters.
Wayne W. Congar PC offers the necessary protection and peace of mind through placement of title insurance in both residential and commercial transactions.
Mr Congar is associated with a full service title agency, we service individual purchasers, business entities and real estate developers. Title insurance is placed through Old Republic National Title Insurance Co. or Fidelity National Title Insurance Co, two of the largest and experienced title insurers in the U.S.
Clearly, every purchaser should obtain title insurance and most every mortgage lender or construction lender will require it. My legal representation at settlement will assure that you obtain clear and marketable title, that the requirements of the Real Estate Settlement Procedures Act (RESPA) and all applicable laws and regulations are closely adhered to and I will insist that all matters adverse to title be resolved including the following:
Liens, mortgages or other encumbrances
Unpaid real estate taxes
Unpaid condominium or homeowner association fees
Municipal or utility company claims
Judgments against the seller’s assets
Errors in legal description
Covenants, conditions or restrictions on use of the property such as easements, rights of way, etc
Pending claims for quiet title, adverse possession, etc
Outsales of portions of the property to third parties
